Terms of Service

1. By clicking on the agreeing to our Terms of Service button, you are stating that you have read our policies, procedures, and terms of service,  and agree to the policies, procedures,and terms of service of Hawaiian Fit Meals; which the terms of service for Hawaiian Fit Meals is accessible through the link when checking out , when clicking to agree to the Terms of Service.

2. This is an agreement for weekly meal plan subscription service with Hawaiian Fit Meals. Upon execution of this agreement, the subscriber understands and agrees that:
– Weekly Subscription Meal Plans and Weekly Subscription Meal Plans with Contract are sold at a discounted rate determined by the length of time that the subscriber has agreed upon by subscribing.
– Because meals plans are made to order, purchased in advance and discounted for length of subscription service, the subscriber understands that this agreement is non-cancellable and no refunds will be given.
– Should subscriber default on this agreement, Hawaiian Fit Meals will suffer the loss of not only the up-front costs associated with the purchase of food products for the subscriber, but also the loss of revenue associated with the discount given to the subscriber for the length of time the subscriber committed to when subscribing.Therefore, subscriber understands and agrees that this agreement is non-cancellable and no refunds of any kind will be given.

3. SUBSCRIBER IS RESPONSIBLE FOR READING THIS AGREEMENT AND ADDENDUMS TO ASSURE THAT THIS IS THE CORRECT MEAL PLAN THEY WISH TO SUBSCRIBE TO PRIOR TO SUBMITTING APPROVAL, WHICH ENTERS THE SUBSCRIBER INTO A LEGAL BINDING CONTRACT. Hawaiian Fit Meals will strive to fulfill this agreement exactly as it is written. NO VERBAL AGREEMENTS OR REPRESENTATIONS WILL BE HONORED.

4. Subscriber understands that Hawaiian Fit Meals offer four different meal plans to choose from, which are listed below and on our website, and the subscriber has read about each plan, their requirements, and have selected which plan is best for them and want to commit to, agreeing to the terms of service by subscribing and submitting payment.

One Time Purchase Meal Plans
This meal plan is ideal and very popular for those wanting to try out our meals or for vacationers wanting to eat healthy while here. You will select the number of meals that you would like to have delivered for the upcoming week that you are purchasing. You will receive only 1 week of meals and will be billed only 1 time.

Bulk Meal Plans
This meal plan is ideal for those wanting to lock in lower pricing, but not wanting meals delivered weekly. You will select the number of meals that you would like to purchase, and each time you place an order, the number of meals that you order will be deducted from the total number of meals that you have purchased. You are required to order at least 5 meals, each time that you place an order to be delivered. However, there is not expiration on this plan; use them as you want them. When you are ready to order, submit the meals that you would like to have delivered for the upcoming week that you are interested in purchasing. You will receive your meals during our normal Monday delivery.

Weekly Subscription Plans
This meal plan is by far our most popular and offers discounted pricing. You will select the number of meals that you would like to subscribe to, and have delivered each week. You are setup on recurring billing that gets debited from credit or debit card, every 7 days from the date that you signed up for service. There is a three week minimum subscription term for this plan. However, there is a 4 week maximum pause term during each 6 month time period.  When requesting to pause your account, you must provide us with the dates that you wish to pause and resume, otherwise we will input your pause for one week, resuming your service the following week after your one week pause.You can upgrade to a larger meal plan, however, you cannot downgrade to a lower meal plan for the duration of your 3 week minimum term. You may however, elect to buy out of your minimum term at the rate of $250 or 50% of the remaining weekly cost of the remaining weeks left in your minimum term, whichever is greater. We have over 30 menu items to choose from each week, so you will not get bored or tired of our menu. We also rotate out 5 meals each month that are ordered the least and replace them with new items that are added to the menu to choose from and order. We also offer a random selection, just tell us what you don’t like and we will randomly select your meals for you (this is a very popular option for those on the go and don’t have time to place an order each week). Our deadline to place new orders is every Friday at 8 a.m. If you are on a subscription plan and we do not receive a new order for you, you will receive the same meals from the previous order that you placed.

You can pause or cancel your account at anytime after the three week minimum subscription requirement. You must email us directly at eatwell@hawaiianfitmeals.com, to pause or cancel your account. You must notify us 48 hours prior to your billing date to cancel your account, if you notify us after this time, your cancellation will be submitted for the following week. You will not be billed while your account is on pause, however, you must notify us 48 hours prior to your subscription billing day (which is the day of the week that you originally signed up for the subscription plan of your choice), to not be billed for that week. If you pause your account within or after 48 hours of your subscription payment day (which is the day of the week that you originally signed up for the subscription plan of your choice), you will receive an in house credit for the meals for the paused week, which can be used towards the week you return. We do not offer refunds of any kind once your subscription has been renewed (which is 48 hours prior to your subscription payment day of the week). You must also notify us by 8 am on Friday’s if you are wanting to pause or cancel your account for the upcoming week, otherwise your meals will have already be sent to the kitchen to be purchased and cooked; which you will not receive a refund or an in house credit if you fail to notify us of your pause or cancel request by 8 am on Friday for the upcoming delivery.

This meal plan by far offers the best pricing. You will select the number of meals that you would like to subscribe to and have delivered each week. There is a six month, minimum subscription term for this plan. Subscriber understands and agrees that this agreement is a legal binding contract, and is non-cancellable, and no refunds of any kind will be given.  You may however, elect to buy out of your contract at the rate of $250 or 50% of the remaining weekly cost of the remaining weeks left in your contract, whichever is greater.   We have over 30 menu items to choose from each week, so you will not get bored or tired of our menu. Once your six month subscription term is satisfied, you will automatically continue on a weekly basis at the 6 month subscription term pricing. Once your six month subscription term has been satisfied, you can cancel at any time by emailing us directly at eatwell@hawaiianfitmeals.com. You must notify us 48 hours prior to your subscription billing day (which is the day of the week that you originally signed up for the subscription plan of your choice), to not be billed for the upcoming week. If you cancel your account within or after 48 hours of your subscription payment day (which is the day of the week that you originally signed up for the subscription plan of your choice), you will receive meals for the upcoming week. We do not offer refunds of any kind once your subscription has been renewed (which is 48 hours prior to your subscription payment day of the week). You must also notify us by 8 am on Friday’s if you are wanting to cancel your account for the upcoming week, otherwise your meals will have already be sent to the kitchen to be purchased and cooked; which you will not receive a refund or an in house credit if you fail to notify us on time.

5. In the event meals are suspended for non-payment and subsequently restored for payment made, subscriber understands that meals not delivered during the suspension will not be credited, refunded, re-made, or re-delivered.

6.Your meals will be delivered via FedEx, with ice packs, and insulated with bubble wrap and aluminum, inside a box; in case you’re not home to receive your meals, which allows your meals to  stay at temp. .However, once your meals are delivered to FedEx, we are no longer responsible for maintaining the temperature, they become the responsibility of FedEx, until they are delivered to your door, then they become your responsibility. Once you receive your meals, you must put them in refrigeration. If for any reason that FedEx is unable to deliver your meals due to an address error when entering it into our system, or they are not allowed to leave the package, it is your responsibility to pick up the package at their facility while your meals are still at proper temperature.  If your meals arrive damaged, you must take pictures of the box, inside wrapping, and broken containers and email them to eatwell@hawaiianfitmeals.com.   We will submit a claim with FedEx, once they approve the claim, we will credit your Hawaiian Fit Meals account for the number of meals damaged.  If we do not receive the information necessary to file a claim, or FedEx denies a claim, no credit will be issued to your Hawaiian Fit Meals account.  Claims may take up to 10 business days to receive claim status notification.

If you would like to save your gel ice packs in one of our boxes, you can email us at eatwell@hawaiianfitmeals.com when the box is full of gel ice packs and we will email you a postage page label and schedule a pick-up with FedEx to have shipped back to us.

7. Please keep in mind that we deliver to anywhere in Hawaii, and we ship via FedEx, so we cannot guarantee a time of delivery or tell you how much longer it will be until you receive your package.  FedEx does try to deliver  to business addresses by 5pm, and to residential addresses by 8pm.  If you have a special need or request, please email us at eatwell@hawaiianfitmeals.com and we will try to accommodate you the best we can. Free and discounted delivery service provided by Hawaiian Fit Meals, that may be rescinded at any time, requiring clients to pay for their delivery.

8. Hawaiian Fit Meals is committed to the fair and ethical treatment of customers/subscribers, and our staff.

9. Subscriber hereby accepts full liability and responsibility for all orders placed and understands that Hawaiian Fit Meals will not be responsible for any allergies the subscriber may have to specific ingredients. Subscriber understands that Hawaiian Fit Meals cooks with various types of tree nuts, peanuts, eggs, milk, fish, soybeans, wheat, Crustacean shellfish.

10. Hawaiian Fit Meals will not be liable for failure to furnish meals on time due to strikes, labor disputes, government action, acts of God, terrorism, war, fire, hurricane, flood, windstorm and breakdown of equipment or any other circumstances beyond its control. Hawaiian Fit Meals will deliver meals as quickly as possible if any of these occur and credit subscribers Hawaiian Fit Meals account for any meals not delivered.

11. Subscriber signing personally, jointly and severally guarantees to Hawaiian Fit Meals, and/or its successors and assigns, the prompt payment of all sums of money currently due and/or which may hereinafter become due to Hawaiian Fit Meals for the weekly meal plan subscription that the subscriber selected and subscribed to, or other services provided under this agreement, and upon demand, shall pay such sums of money forthwith to Hawaiian Fit Meals, and/or its successors and assigns. If Subscriber fails to pay as agreed, then Hawaiian Fit Meals may cancel and terminate this agreement without notice and subscriber shall, upon demand, pay Hawaiian Fit Meals for the full amount due under this contract. Hawaiian Fit Meals may elect to file a lawsuit and/or send to collection for Subscribers specific performance of this contract. Subscriber hereby agrees to indemnify Hawaiian Fit Meals, and/or its successors and assigns for all expenses it may incur to enforce collection of any amount due under this agreement, and Subscriber agrees to pay reasonable attorney’s fees and court costs incurred in such collection. In addition, Subscriber shall pay a 1-1/2% per month (18% annual percentage rate) finance charge on all past due balances. Subscriber agrees and understands that venue for any legal action taken by either party in connection with this agreement shall be Honolulu, Hawaii.

12. A late payment fee of $20 will be assessed for any past due payments. A returned item fee of $30 or 5%, whichever is greater, will be charged for any payment items not honored for any reason including, but not limited to dishonored checks and credit card chargebacks. Subscriber agrees and authorizes that any past due balances, late fees and/or returned item fees may be charged to any credit card on file with the Hawaiian Fit Meals at Hawaiian Fit Meals’ discretion.

13. Subscriber agrees that he/she will not dispute any credit card charge associated with this agreement for any reason with their bank, and further understands that Hawaiian Fit Meals Inc. will never give a monetary refund for any reason.
